ModernArtCollections offers superior yacht charter services, which comprise, but are not limited to:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

We ensure service delivery contingent upon availability and meteorological conditions. We retain the prerogative to amend or terminate our services without notice at any given time.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you are required to:

  • Be a minimum of 18 years old
  • Provide accurate and current details
  • Render the requested deposit as indicated in your reservation confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

Your reservation is deemed confirmed only after we have received your payment and sent a written confirmation. We hold the authority to decline providing services to anyone at our own discretion.

3.3 Availability

Charter services are dependent on the availability of vessels and favorable weather conditions. We shall exert reasonable endeavors to meet your preferred scheduling.

4. Payment Terms

4.1 Pricing

Prices are quoted in € and include all relevant taxes unless specified otherwise. Prices are liable to modification without prior notification.

4.2 Payment Schedule

  • Deposit: 50% of the entire charter fee is due at the time of booking
  • Balance: Due 48 hours prior to the charter's departure
  • Supplementary charges (if applicable): Payable upon the completion of the charter

4.3 Payment Methods

Major credit cards, bank transfers, and certified cheques are accepted forms of payment. All payments are processed through secure and encrypted systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Full refund less processing fees
  • 24-72 hours in advance of departure: A refund of 50%
  • Less than 24 hours before departure: No refund will be issued

5.2 Weather Cancellations

If our captain deems weather conditions unsafe, we will propose to:

  • Reschedule your charter without extra charges to another suitable date
  • Issuance of a complete refund if an alternative date cannot be scheduled

5.3 Mechanical Issues

In the event of your assigned vessel encountering mechanical issues, we will strive to provide an appropriate alternative. If an alternative is not available, a complete refund will be furnished.

6. Safety and Conduct

6.1 Safety Requirements

All voyagers must:

  • Adhere to instructions from the crew
  • Utilize the safety gear when stipulated
  • Inform us of any health conditions that might influence their security
  • Stay in assigned areas aboard the vessel

6.2 Prohibited Items

The following are prohibited aboard:

  • Glass containers
  • Illegal substances
  • Firearms or other weapons
  • Excessive non-alcoholic beverages (past reasonable consumption)
  • Pets (unless previously agreed upon)

6.3 Conduct

Passengers must maintain respectful behavior at all times. In the event a passenger's conduct compromises safety or hampers the enjoyment for others, we reserve the right to halt the charter and no refund will be provided.

7. Liability and Insurance

7.1 Our Liability

Our liability shall be confined to the amount paid for the charter. We shall not be liable for:

  • Injuries sustained due to passenger carelessness
  • Theft or harm to personal items
  • Indirect, incidental, or punitive losses
  • Delays due to weather or situations beyond our command

7.2 Insurance Coverage

Comprehensive maritime insurance that covers our boats and operations is actively maintained. It's the responsibility of passengers to arrange their own travel and personal insurance.

7.3 Assumption of Risk

By partaking in our yacht services, you recognize that nautical activities pose inherent dangers and you accept accountability for ensuring your own safety and welfare.

8. Modifications and Itinerary Changes

We hold the right to alter itineraries, paths, or schedules as necessitated by weather, security concerns, or operational demands. Every effort will be undertaken to deliver comparable alternative experiences.

9. Force Majeure

We cannot be held accountable for interruptions, cancellations, or alterations caused by forces outside our control, including, but not restricted to:

  • Extreme meteorological events
  • Natural calamities
  • Regulatory measures
  • Port shutdowns
  • Vehicular malfunctions

10. Privacy and Data Protection
